Cette mesure a \u00e9t\u00e9 con\u00e7ue pour \u00eatre coordonn\u00e9e avec les registres r\u00e9gionaux d\u00e9j\u00e0 existants, suscitant un d\u00e9bat parmi les diff\u00e9rents acteurs du secteur, notamment en ce qui concerne les <strong>g\u00eetes ruraux<\/strong> et leur traitement diff\u00e9renci\u00e9 dans la r\u00e9glementation.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Qu\u2019est-ce que le registre unique de location touristique ?<\/h2>\n\n\n\n<p>Depuis le 1er juillet 2025, <strong>tous les propri\u00e9taires de logements touristiques doivent enregistrer leurs biens sur le <a href=\"https:\/\/www.mivau.gob.es\/vivienda\/ventanilla-unica\/alojamiento-de-uso-turistico\" target=\"_blank\" rel=\"noreferrer noopener\">Guichet Unique du Logement Touristique<\/a><\/strong>, d\u00e9velopp\u00e9 par le Minist\u00e8re du Logement, et obtenir un <strong>num\u00e9ro d\u2019identification national obligatoire<\/strong> pour pouvoir publier leurs biens sur des plateformes num\u00e9riques.<br><strong>Ce syst\u00e8me vise \u00e0 faciliter le contr\u00f4le par les administrations r\u00e9gionales et locales, \u00e0 \u00e9viter la location non r\u00e9glement\u00e9e et \u00e0 unifier les crit\u00e8res au niveau national.<\/strong><\/p>\n\n\n\n<p>Cette mesure r\u00e9pond \u00e9galement aux exigences du <strong>R\u00e8glement (UE) 2024\/1028<\/strong>, qui impose aux \u00c9tats membres de disposer de m\u00e9canismes num\u00e9riques de contr\u00f4le de l\u2019offre de courte dur\u00e9e. Ainsi, l\u2019Espagne s\u2019adapte \u00e0 la l\u00e9gislation europ\u00e9enne tout en renfor\u00e7ant son propre syst\u00e8me d\u2019inspection et de suivi des h\u00e9bergements temporaires.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Registre unique de location : exemption pour les g\u00eetes ruraux inscrits dans les registres r\u00e9gionaux<\/h2>\n\n\n\n<p>L\u2019une des d\u00e9cisions les plus importantes de cette nouvelle r\u00e9glementation est l\u2019<strong>exemption sp\u00e9cifique pour les g\u00eetes ruraux d\u00e9j\u00e0 inscrits dans les registres officiels des communaut\u00e9s autonomes<\/strong>.<br><strong>\u00c0 la suite des demandes de l\u2019Association Espagnole du Tourisme Rural (Asetur)<\/strong>, <strong><a href=\"https:\/\/www.europapress.es\/galicia\/turismo-00624\/noticia-casas-rurales-estaran-exentas-nuevo-registro-alquiler-turistico-reunirse-vivienda-20250619111242.html\" target=\"_blank\" rel=\"noreferrer noopener\">le minist\u00e8re du Logement a accept\u00e9 que ces h\u00e9bergements ne soient pas oblig\u00e9s de s\u2019enregistrer une seconde fois<\/a><\/strong>, \u00e0 condition qu\u2019ils figurent d\u00fbment dans les catalogues touristiques de leur r\u00e9gion.<\/p>\n\n\n\n<p>Cette d\u00e9cision repr\u00e9sente un <strong>soulagement important pour les zones rurales<\/strong>, o\u00f9 les marges \u00e9conomiques des activit\u00e9s touristiques sont souvent plus faibles, et o\u00f9 la charge administrative peut avoir un impact disproportionn\u00e9. Elle est \u00e9galement en ligne avec les recommandations d\u2019organismes comme <strong><a href=\"https:\/\/www.tourspain.es\/\" target=\"_blank\" rel=\"noreferrer noopener\">Turespa\u00f1a<\/a><\/strong>, qui, dans son <strong><a href=\"https:\/\/www.tourspain.es\/es\/planes-operativos-turismo\/\" target=\"_blank\" rel=\"noreferrer noopener\">Plan Op\u00e9rationnel Annuel 2025<\/a><\/strong>, <strong>souligne la n\u00e9cessit\u00e9 de renforcer le r\u00f4le du tourisme rural comme moteur de coh\u00e9sion territoriale et de d\u00e9veloppement \u00e9conomique durable.<\/strong><\/p>\n\n\n\n<h2 class=\"wp-block-heading\">G\u00eetes ruraux vs. logements de vacances<\/h2>\n\n\n\n<p>Comprendre la diff\u00e9rence entre <strong>g\u00eetes ruraux en location<\/strong> et <strong>logements de vacances<\/strong> est essentiel pour bien interpr\u00e9ter la r\u00e9glementation sur la location touristique et ses effets concrets.<br><strong>Bien que les deux formes fassent partie du march\u00e9 de la location de courte dur\u00e9e, leur nature juridique, leur fonctionnement et leur implantation territoriale sont clairement distincts<\/strong>, ce qui justifie que le <strong>nouveau registre national de la location touristique<\/strong> ne les traite pas de mani\u00e8re homog\u00e8ne.<\/p>\n\n\n\n<p>Les <strong>g\u00eetes ruraux<\/strong> sont soumis \u00e0 des r\u00e9glementations r\u00e9gionales, comme dans des communaut\u00e9s telles que <strong>Castille-et-Le\u00f3n, la Navarre ou les Asturies<\/strong>, qui exigent une inscription pr\u00e9alable dans le registre touristique r\u00e9gional correspondant.<br><strong>Ces h\u00e9bergements, situ\u00e9s en zones rurales ou naturelles, offrent des services compl\u00e9mentaires (m\u00e9nage, restauration, activit\u00e9s) et sont soumis \u00e0 des inspections r\u00e9guli\u00e8res.<\/strong><br>Selon <strong>Asetur<\/strong>, les g\u00eetes ruraux ne doivent pas \u00eatre assimil\u00e9s aux logements de vacances, <a href=\"https:\/\/www.idealista.com\/news\/inmobiliario\/vivienda\/2025\/06\/19\/849944-las-casas-rurales-estaran-exentas-del-nuevo-registro-de-alquiler-turistico\" target=\"_blank\" rel=\"noreferrer noopener\">car ils appartiennent \u00e0 un <strong>mod\u00e8le de tourisme professionnel<\/strong><\/a>, avec <strong>une forte contribution au d\u00e9veloppement rural, \u00e0 la coh\u00e9sion territoriale et \u00e0 l\u2019\u00e9conomie locale.<\/strong><\/p>\n\n\n\n<p>En revanche, les <strong>logements de vacances<\/strong>, principalement situ\u00e9s dans <strong>des zones urbaines ou tr\u00e8s touristiques<\/strong>, ont historiquement \u00e9t\u00e9 <strong>moins r\u00e9glement\u00e9s<\/strong> et con\u00e7us pour <strong><a href=\"https:\/\/sede.agenciatributaria.gob.es\/Sede\/vivienda-otros-inmuebles\/tributacion-arrendador-viviendas-otros-inmuebles\/tributacion-alquiler-apartamentos-turisticos_.html\" target=\"_blank\" rel=\"noreferrer noopener\">maximiser la rentabilit\u00e9 \u00e0 court terme<\/a><\/strong>, avec <strong>moins d\u2019implication sociale<\/strong> et <strong>un impact plus fort sur le parc de logements r\u00e9sidentiels<\/strong>.<br>Le <strong>nouveau registre de location touristique exige leur enregistrement<\/strong>, afin d\u2019<strong>\u00e9viter l\u2019opacit\u00e9 de l\u2019offre, prot\u00e9ger le logement r\u00e9sidentiel et am\u00e9liorer la transparence<\/strong> dans les zones \u00e0 forte demande.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Fiscalit\u00e9 : diff\u00e9rences entre g\u00eetes ruraux et logements de vacances<\/h2>\n\n\n\n<p>Sur le plan fiscal, les <strong>g\u00eetes ruraux<\/strong> qui offrent des services similaires \u00e0 ceux de l\u2019h\u00f4tellerie (comme le m\u00e9nage r\u00e9gulier, la r\u00e9ception ou la restauration) sont consid\u00e9r\u00e9s comme exer\u00e7ant une <strong>activit\u00e9 \u00e9conomique<\/strong>, ce qui implique des obligations en mati\u00e8re de <strong>TVA, d\u2019imp\u00f4t sur les activit\u00e9s \u00e9conomiques (IAE) et d\u2019imp\u00f4t sur le revenu (IRPF)<\/strong>.<br>\u00c0 l\u2019inverse, de nombreux <strong>logements de vacances sans services compl\u00e9mentaires<\/strong> sont impos\u00e9s en tant que <strong>revenus du capital immobilier<\/strong>, dans un cadre fiscal <strong>moins exigeant<\/strong>. C\u2019est pourquoi les autorit\u00e9s cherchent \u00e0 <strong>aligner les exigences de contr\u00f4le et de transparence fiscale<\/strong>, surtout en milieu urbain, o\u00f9 prolif\u00e8rent les h\u00e9bergements sans encadrement ad\u00e9quat.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Opportunit\u00e9s d\u2019investissement : Urbanitae et le registre unique de location<\/h2>\n\n\n\n<p>La
