Quelle que soit votre exp\u00e9rience en mati\u00e8re d&#8217;investissement, il est peu probable que vous soyez un investisseur averti. Il ne s&#8217;agit pas de ce que vous pensez, mais de ce que dit la loi. Attendez, je vais vous dire.<\/p>\n\n\n\n<p>Tout d&#8217;abord, nous parlons de <strong>l&#8217;investissement par crowdfunding immobilier<\/strong>. Comme vous le savez peut-\u00eatre &#8211; et si vous ne le savez pas, nous sommes l\u00e0 pour \u00e7a &#8211; il s&#8217;agit d&#8217;une activit\u00e9 supervis\u00e9e par la Commission nationale des valeurs mobili\u00e8res (CNMV). Mais ce n&#8217;est pas tout : le crowdfunding est r\u00e9glement\u00e9 au niveau europ\u00e9en. En effet, en 2020, le <a href=\"https:\/\/www.boe.es\/buscar\/doc.php?id=DOUE-L-2020-81532\">r\u00e8glement (UE) 2020\/1503<\/a> a \u00e9t\u00e9 adopt\u00e9, cr\u00e9ant <strong>un cadre commun pour les plateformes de crowdfunding (PFP)<\/strong> dans l&#8217;Union europ\u00e9enne (UE).<\/p>\n\n\n\n<p>Bien que le r\u00e8glement europ\u00e9en date de 2020, il ne commencera \u00e0 \u00eatre appliqu\u00e9 en Espagne qu&#8217;en novembre 2021. Dans notre pays, les PFP \u00e9taient r\u00e9gis par la loi 5\/2015 ; l&#8217;adaptation de la loi au nouveau cadre europ\u00e9en est intervenue avec la loi 18\/2022, qui comprend un nouveau r\u00e9gime juridique pour ces plateformes, en vigueur depuis novembre de l&#8217;ann\u00e9e derni\u00e8re. Urbanitae n&#8217;a pas attendu longtemps et a m\u00eame \u00e9t\u00e9 la premi\u00e8re entreprise de son secteur \u00e0 obtenir <a href=\"https:\/\/blog.urbanitae.com\/2022\/10\/18\/somos-la-primera-plataforma-en-lograr-autorizacion-europea\/?utm_source=blog&amp;utm_medium=referral&amp;utm_campaign=urbanitae_blog_0423&amp;utm_term=licencia+europea&amp;utm_content=matias_inversor_experimentado\">l&#8217;autorisation d&#8217;op\u00e9rer dans l&#8217;UE<\/a>.&nbsp;<\/p>\n\n\n\n<p>Je vous dis tout cela parce que l&#8217;une des nouveaut\u00e9s du nouveau cadre europ\u00e9en concerne les types d&#8217;investisseurs. <strong>Auparavant, la loi distinguait deux cat\u00e9gories<\/strong> : <a href=\"https:\/\/blog.urbanitae.com\/2022\/03\/22\/en-que-radica-la-distincion-entre-inversor-acreditado-y-no-acreditado\/?utm_source=blog&amp;utm_medium=referral&amp;utm_campaign=urbanitae_blog_0423&amp;utm_term=aprende+con+matias&amp;utm_content=matias_inversor_experimentado\"><strong>les investisseurs accr\u00e9dit\u00e9s et les investisseurs non accr\u00e9dit\u00e9s<\/strong><\/a><strong>.<\/strong> La raison d&#8217;\u00eatre de ces deux cat\u00e9gories est protectrice : il s&#8217;agit de diff\u00e9rencier les investisseurs professionnels des investisseurs particuliers &#8211; comme vous et moi &#8211; afin que ces derniers aient plus de mal \u00e0 prendre des risques qu&#8217;ils pourraient regretter.<\/p>\n\n\n\n<p>Par exemple, les investisseurs non accr\u00e9dit\u00e9s ne pouvaient pas investir dans des projets de plus de 2 000 000 d&#8217;euros. Et ils avaient une limite d&#8217;investissement pour tous les projets : 3 000 euros par projet et 10 000 euros sur une p\u00e9riode de 12 mois. Il n&#8217;y avait pas de limites pour les investisseurs accr\u00e9dit\u00e9s. Mais pour \u00eatre consid\u00e9r\u00e9 comme tel, il faut non seulement en faire la demande, mais aussi remplir l&#8217;une de ces conditions :&nbsp;<\/p>\n\n\n\n<ul>\n<li>Disposer d&#8217;un revenu annuel sup\u00e9rieur \u00e0 50 000 euros ou d&#8217;un patrimoine financier sup\u00e9rieur \u00e0 100 000 euros.<\/li>\n\n\n\n<li>Preuve de l&#8217;obtention d&#8217;un service de conseil financier sur les instruments de financement de la plateforme aupr\u00e8s d&#8217;une soci\u00e9t\u00e9 de services d&#8217;investissement agr\u00e9\u00e9e.<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\">Pas de limites mais avec prudence<\/h2>\n\n\n\n<p>Tout cela change avec la nouvelle norme europ\u00e9enne. La principale nouveaut\u00e9 est que <strong>tout le monde peut investir sans limite de montant<\/strong>. N\u00e9anmoins, il existe toujours des classes, mais elles s&#8217;appellent d\u00e9sormais : investisseur averti et investisseur non averti. L&#8217;exp\u00e9rience est essentielle, mais pas n&#8217;importe qui&#8230; Les conditions pour \u00eatre un investisseur averti sont plus difficiles \u00e0 remplir. Par souci d&#8217;exhaustivit\u00e9, nous ne parlerons que des individus (et non des entreprises). Au moins deux de ces trois conditions doivent \u00eatre remplies :<\/p>\n\n\n\n<ul>\n<li>Avoir un revenu brut d&#8217;au moins 60 000 euros ou un portefeuille d&#8217;instruments financiers, d\u00e9fini comme comprenant les d\u00e9p\u00f4ts en esp\u00e8ces et les actifs financiers, de plus de 100 000 euros.<\/li>\n<\/ul>\n\n\n\n<ul>\n<li>Travailler ou avoir travaill\u00e9 dans le secteur financier pendant au moins un an \u00e0 un poste professionnel n\u00e9cessitant une connaissance des op\u00e9rations ou des services envisag\u00e9s, ou avoir occup\u00e9 un poste de direction pendant au moins 12 mois ;<\/li>\n<\/ul>\n\n\n\n<ul>\n<li>Avoir effectu\u00e9 des transactions de taille significative sur les march\u00e9s des capitaux \u00e0 une fr\u00e9quence moyenne de dix par trimestre au cours des quatre trimestres pr\u00e9c\u00e9dents.<\/li>\n<\/ul>\n\n\n\n<p>Si vous ne remplissez pas les conditions requises, il n&#8217;y a pas de probl\u00e8me, car, comme je l&#8217;ai dit, tout investisseur peut investir sans limites dans le cadre du nouveau r\u00e8glement. Toutefois, <strong>les investisseurs inexp\u00e9riment\u00e9s recevront un avertissement de risque s&#8217;ils investissent 1 000 euros ou 5 % de leur patrimoine<\/strong>, le montant le plus \u00e9lev\u00e9 \u00e9tant retenu. Les personnes inexp\u00e9riment\u00e9es disposent d&#8217;un autre outil : le droit de r\u00e9tractation. En particulier, ils disposeront d&#8217;un d\u00e9lai de r\u00e9flexion de quatre jours pour retirer leur investissement sans frais.<\/p>\n\n\n\n<p>Maintenant, vous savez.
