font-family: Roboto, sans-serif; font-size: 16px;\">Le r\u00e8glement (UE) 2020\/1503 \u00e9tablit deux fa\u00e7ons d\u2019\u00eatre consid\u00e9r\u00e9 comme un investisseur exp\u00e9riment\u00e9 :<\/p><ol><li style=\"color: #212121; font-family: Roboto, sans-serif; font-size: 16px;\"><strong>Clients professionnels selon MiFID II :<\/strong> Ceux qui sont d\u00e9j\u00e0 consid\u00e9r\u00e9s comme des clients professionnels conform\u00e9ment \u00e0 l\u2019annexe II, section I, points 1 \u00e0 4 de la directive 2014\/65\/UE (MiFID II), tels que les institutions financi\u00e8res, les grandes entreprises ou les gouvernements.<\/li><li style=\"color: #212121; font-family: Roboto, sans-serif; font-size: 16px;\"><strong>\u00c9valuation par le prestataire de financement participatif :<\/strong> Les personnes physiques ou morales qui, bien que n\u2019\u00e9tant pas des clients professionnels au titre de MiFID II, peuvent \u00eatre consid\u00e9r\u00e9es comme des investisseurs exp\u00e9riment\u00e9s si elles r\u00e9pondent \u00e0 certains crit\u00e8res financiers et d\u2019exp\u00e9rience, et demandent un tel traitement au prestataire de services de financement participatif.<\/li><\/ol><p style=\"color: #212121; font-family: Roboto, sans-serif; font-size: 16px;\">Pour <strong>les personnes morales<\/strong>, il est n\u00e9cessaire de r\u00e9pondre \u00e0 au moins l\u2019un des crit\u00e8res suivants :<\/p><ul><li style=\"color: #212121; font-family: Roboto, sans-serif; font-size: 16px;\">Disposer de ressources propres d\u2019au moins 100.000 euros.<br>\u200b<\/li><li style=\"color: #212121; font-family: Roboto, sans-serif; font-size: 16px;\">Avoir un chiffre d\u2019affaires net d\u2019au moins 2 000 000 euros.<br>\u200b<\/li><li style=\"color: #212121; font-family: Roboto, sans-serif; font-size: 16px;\">Avoir un solde d\u2019au moins 1 000 000 euros.<br>\u200b<\/li><\/ul><p style=\"color: #212121; font-family: Roboto, sans-serif; font-size: 16px;\">Pour <strong>les personnes physiques<\/strong>, au moins deux des crit\u00e8res suivants doivent \u00eatre remplis :<\/p><ul><li style=\"color: #212121; font-family: Roboto, sans-serif; font-size: 16px;\">Revenu brut personnel d\u2019au moins 60 000 \u20ac par ann\u00e9e d\u2019imposition, ou portefeuille d\u2019instruments financiers de plus de 100 000 \u20ac.<br>\u200b<\/li><li style=\"color: #212121; font-family: Roboto, sans-serif; font-size: 16px;\">Avoir travaill\u00e9 dans le secteur financier pendant au moins un an \u00e0 un poste n\u00e9cessitant une connaissance des op\u00e9rations ou des services envisag\u00e9s, ou avoir occup\u00e9 un poste de direction pendant au moins 12 mois dans une entit\u00e9 juridique r\u00e9pondant aux crit\u00e8res ci-dessus pour les personnes morales.<br>\u200b<\/li><li style=\"color: #212121; font-family: Roboto, sans-serif; font-size: 16px;\">Avoir r\u00e9alis\u00e9 des op\u00e9rations de volume significatif sur les march\u00e9s de capitaux avec une fr\u00e9quence moyenne de 10 par trimestre au cours des quatre trimestres pr\u00e9c\u00e9dents.<br>\u200b<\/li><\/ul><p style=\"color: #212121; font-family: Roboto, sans-serif; font-size: 16px;\">La demande pour \u00eatre assimil\u00e9 \u00e0 un investisseur exp\u00e9riment\u00e9 doit \u00eatre accompagn\u00e9e d\u2019une attestation pr\u00e9cisant les crit\u00e8res remplis, d\u2019une d\u00e9claration attestant que le demandeur est conscient des cons\u00e9quences de la perte de la protection li\u00e9e \u00e0 la cat\u00e9gorie des investisseurs non exp\u00e9riment\u00e9s et d\u2019une d\u00e9claration de responsabilit\u00e9 quant \u00e0 la v\u00e9racit\u00e9 des informations fournies.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-11c28c4 elementor-widget__width-initial elementor-widget elementor-widget-text-editor\" data-id=\"11c28c4\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<h3>Principaux aspects \u00e0 prendre en compte<\/h3>\n<ul>\n \t<li style=\"color: #212121; font-family: Roboto, sans-serif; font-size: 16px;\"><strong>Moins de protection r\u00e9glementaire :<\/strong> Les investisseurs exp\u00e9riment\u00e9s ne sont pas soumis \u00e0 certaines mesures de protection qui s\u2019appliquent aux investisseurs non exp\u00e9riment\u00e9s, telles que des tests de connaissances ou des avertissements sp\u00e9cifiques sur les risques.<\/li>\n \t<li style=\"color: #212121; font-family: Roboto, sans-serif; font-size: 16px;\"><strong>Acc\u00e8s \u00e0 des opportunit\u00e9s d\u2019investissement plus larges :<\/strong> En \u00e9tant consid\u00e9r\u00e9s comme capables de prendre de plus grands risques, ils peuvent acc\u00e9der \u00e0 un plus large \u00e9ventail de projets de financement participatif sans les restrictions impos\u00e9es aux investisseurs inexp\u00e9riment\u00e9s.<\/li>\n \t<li style=\"color: #212121; font-family: Roboto, sans-serif; font-size: 16px;\"><strong>Validit\u00e9 temporaire de la qualification :<\/strong> Le statut d\u2019investisseur exp\u00e9riment\u00e9 est valable deux ans, apr\u00e8s quoi il doit \u00eatre renouvel\u00e9 par le biais d\u2019une nouvelle \u00e9valuation.<\/li>\n<\/ul>\n<p style=\"color: #212121; font-family: Roboto, sans-serif; font-size: 16px;\">\u00catre reconnu comme un investisseur exp\u00e9riment\u00e9 vous permet d\u2019acc\u00e9der \u00e0 un plus large \u00e9ventail d\u2019opportunit\u00e9s d\u2019investissement sur les plateformes de crowdfunding, avec moins de restrictions et une plus grande flexibilit\u00e9. Cependant, cette cat\u00e9gorie s\u2019accompagne d\u2019une protection r\u00e9glementaire moindre, ce qui implique que l\u2019investisseur doit avoir une solide compr\u00e9hension des risques associ\u00e9s et la capacit\u00e9 financi\u00e8re d\u2019assumer des pertes potentielles.
